MLEP 2011 Amendment 2 came into force on 11 November 2015. MDCP 2011 Amendment 2 will come into force in December 2015 when Council notifies this in the local print media.

Update, 14 August 2015

Two LEP/DCP Amendment 2 post public exhibition reports were considered by Council at its 7 July 2015 meeting. These reports are Items 1 and 2 within the business paper for the 7 July meeting. The reports and associated Council resolutions are available for download at:

After considering these reports, Council resolved to forward final draft LEP Amendment 2 to the Department of Planning & Environment (DP&E) for final review and approval. It is anticipated that LEP/DCP Amendment 2 will come into force before the end of 2015.

Draft Marrickville Local Environmental Plan (MLEP) 2011 and Draft Marrickville Development Control Plan (MDCP) 2011 Amendment No. 2 are on public exhibition from 31 July to 6 October 2014 inclusive.

Draft MLEP 2011 Amendment No.2 aims to increase the useability of the plans by addressing anomalies and errors, and to introduce new development controls to improve planning.

This amendment, which affects the entire local government area, includes:

  • changes to the flood maps to account for new flood studies for Eastern Channel East and Marrickville Valley and the Cooks River Floodplain;
  • a new Heritage Item and Heritage Conservation Area;
  • site-specific amendments to planning controls on individual sites; and
  • other amendments that achieve the aims mentioned above

Draft MDCP 2011 Amendment No.2 includes changes to various sections of the DCP, including:

  • car parking;
  • tree management;
  • landscaping and open space; and managing contaminated land.

It also includes new sections relating to stormwater management, boarding houses, child care centres and precinct development controls.

Anyone can make a written submission on these draft amendments.  Submissions must be received by 5:00pm on 1 September 2014. Submissions should be addressed to the General Manager, Marrickville Council 2-14 Fisher Street Petersham or email council@marrickville.nsw.gov.au.

What happens next?

After the public exhibition, all submissions received will be reported to Council and further amendments may be recommended as a result of these submissions.

In accordance with Council's resolution, a planning proposal for MLEP 2011 Amendment No. 2 was submitted to the DP&E on 8 October 2013, seeking Gateway determination.  The Gateway determination, issued on 14 March 2014, is included in the exhibition material mentioned above.
